Advisers

SeekER is an Internet information only portal developed by ER IT Solutions, and offers no advice.

Advisers both financial and legal will be granted a non-exclusive, non-transferable, limited licence to access and use the Online Services and Materials all the time they subscribe to the materials, subject to the terms and conditions of this agreement.
Verified or Premium subscribers agree to ensure and hereby guarantee that only Authorised Users will have access to the Online Services and Materials and that such Authorised Users only use the Online Services and Materials in accordance with this agreement

You will be responsible for all advice and content of your own listing at all times.
All right, title and interest (including all copyrights and other intellectual property rights) in the Online Services and Materials (in both print and machine-readable forms) belong to the Licensor or the Licensor's third party suppliers. Subscribing advisers will only receive an ongoing licence to access online services and data for the duration of subscription. At no time will any adviser whether subscribing to the service or not, acquire any ownership of copyright or other intellectual property rights or proprietary interest in the Online Services or Materials or copies thereof.

To apply for a verified or premium listing you must supply ER IT Solutions with all required documentation to prove your authorisation as well as a valid method of payment. You will not be given a verified or premium listing until such time as you have provided us with proof of your equity release qualification and we have confirmed your method of payment is valid. Until such time you will be given or allowed to keep any free listing. You also agree to notify us immediately should for whatever reason your permissions to advise on regulated equity release ceases or you retire.

All Verified and Premium listed advisers gain access to our unique product criteria wizard which has been compiled from answers provided by product providers. It is provided only as a guide to help you identify possible providers who may be willing to help. It should not be relied upon as any impartial research and whilst every effort will be made to try and keep it up to date SeekER and ER IT Solutions cannot be held responsible for changes in criteria and therefore it’s accuracy.

All Premium paying listings provide advisers with the opportunity to receive an unlimited number of enquiries per month for one set fee, no refunds or any compensation in any form will be offered for any false enquiries received. SeekER or ER IT Solutions cannot guarantee any specific volume of enquiries.

SeekER or ER IT Solutions will not be responsible for any inconvenience caused, expense incurred by you from following up any bogus enquiries. Nor will we be liable for any damage caused to your computer system by any viruses contracted through linking your site with SeekER.

Subscribers will confirm that they have provided ER IT Solutions with a correct and valid email address for subscription purposes, acceptance of which shall be evidenced by the issuance by ER IT Solutions of a password and login information.

Any password issued by ER IT Solutions is personal and confidential to the Authorised User. If ER IT Solutions suspects that any password is being used by any person who is not an Authorised User, that password may be amended and the account may be suspended. Please keep all login details securely and never allow anybody else to use your details.

Provision of service

Whilst every effort will be made to maintain service ER IT Solutions cannot be responsible nor will make any refund for any period of time where the site is non operational unless this is due solely to ER IT Solutions, should the SeekER website at any time be unavailable solely due to ER IT Solutions then at our own discretion we may provide refunds or concessions.

ER IT Solutions will endeavour to optimise the site at all times for major search engines but doesn’t offer any guarantee as to how high the site will appear.

Price and Terms of Payment

Subscription fees are payable at any given time for the Verified and Premium listings and shall be the total price specified by ER IT Solutions on the SeekER website.

If you choose to purchase a recurring monthly subscription for a Verified or Premium listing the appropriate monthly subscription fee will be taken monthly at the start of the subscription period or subsequent renewal period. Successful payment of the subscription fee will grant the Subscriber a subscription period or renewal period of one calendar month. The Subscriber can terminate a recurring monthly subscription at any time, which will prevent further payment from being taken, but no refunds for part periods will be given.

Upon the expiry of the subscription, you will automatically be downgraded to a free listing.

The subscription fees shall be paid by the Subscriber for the first subscription period and any subsequent Renewal Periods in advance of being granted access to the Online Services and Materials for such periods.
The subscription fees may from time to time be changed. If you are already a subscribing adviser we undertake to give you at least 6 weeks notice of any such change.

Limitation of Liability

We do not provide any legal, financial or other advice. We do not make any recommendations or endorsement as to any product or service supplied by any registered advisers or third party linked to by our Websites.

We provide our Website and services on an “as is” basis without any warranty or condition, whether implied or otherwise. We have no control over, nor responsibility for, any information provided by you to a third party directly or indirectly through our website. We have no control over, and do not accept liability for, the actions of any Firm with whom you decide to Contract with as a result of visiting our Website.

We are not liable to you or any third party for any indirect or consequential loss or damage, loss of profits, contracts, or other revenue or business caused by, or arising from, the use of our Website.

Nothing in this Agreement limits our liability for death or personal injury resulting from our negligence or the negligence of our employees or our liability for fraudulent misrepresentation.


Applicable Law

All disputes arising out of, or relating to, the use of personal information will be governed by English Law and you agree to submit to the non exclusive jurisdiction of the English Courts.

Force Majeure

We will not be liable for any breach of these terms and conditions of use or any failure to provide or delay in providing our services via our Website resulting from any circumstance or event beyond our reasonable control including, without limitation, failure or breakdown of systems or network access, fire, explosion or accident.

Termination

The Licensor may suspend or discontinue providing the Online Services and Materials to the Subscriber without notice and pursue any other remedy legally available to it if the Subscriber fails to comply with any of its obligations under this agreement.

Either party may terminate this agreement forthwith on written notice if the other party becomes insolvent, becomes bankrupt, makes an arrangement with its creditors or goes into liquidation.

Termination of this agreement shall not prejudice any rights of either party which have arisen on or before the date of termination.

Data Protection & Privacy Statement

Any information you supply to SeekER or ER IT Solutions will be processed only for purposes for which we have registered under the Data Protection Act. Upon receipt of your written request, together with an administration fee of £10, we will provide you with a copy of the information which we hold concerning you.

Any personal details which you submit to SeekER will be the responsibility of ER IT Solutions and will be processed by us under the terms of our Data Protection Licence. It is your responsibility to ensure that this personal data is accurate and up to date and to inform us of any changes that need to be made. ER IT Solutions may use your personal data for the purposes notified by us to the Information Commissioner. By submitting your personal data to us, you consent to it being processed by ER IT Solutions.

Any personal details which you submit via SeekER to registered advisers will be the responsibility of the adviser and will be processed by them under the terms of their Data Protection Licence.
